The duty drivers have to ensure it is safe before passing
How dashcam footage can clearly establish fault
Why panic reactions can worsen crash outcomes
How these types of accidents often result in severe injuries

โš–๏ธ Legal Insight:

In this case, the driver attempting to pass an 18-wheeler on a foggy road is 100% liable for the crash. The law places full responsibility on the passing driver to ensure there is enough space, time, and visibility to complete the maneuver safely.

If a driver cannot clearly see the road ahead, they cannot legally take the risk of passing.

๐Ÿšจ What Went Wrong:
Attempting to pass in foggy, low-visibility conditions
Failing to ensure a safe distance from oncoming traffic
Both drivers reacting at the last second and moving toward the same shoulder
A preventable decision leading to a high-impact head-on collision

These types of crashes often result in catastrophic injuries due to the force of impact.

Well, that's just wildly reckless driving. I mean, I'm not even sure what to say about that. There's, there's nothing legal going on in that video. First of all, they should get a ticket for their music. Let's start there.

That's, that's an outrageous tune. To be breaking the double yellow on. That's number one. Number two, you're allowed to pass cars that are in front of you if it is a broken yellow line. Regardless, he's liable for this accident 100% anyway, because the burden of maintaining a safe distance and assuring that there's enough room to pass is on the driver who is doing the passing.

So in this case, what you see is, first of all, it looks like a foggy day, so it's difficult to see far ahead. He's trying to pass a, what appears to be an 18-wheeler, and that obstructs his view of the cars that are coming up on the left-hand side. The law's pretty clear. If you can't see, you can't take a risk. If you're not sure, you can't pass.

And what this guy did was he attempted to pass the 18-wheeler. A car was coming the other direction. He panics. It looks like he moves to the shoulder. The, the, the oncoming car similarly panics, turns to the right, and they meet on the shoulder in a head-on collision.

I'm sure there were pretty significant injuries, as there normally are in head-on collisions. But this driver, in addition to having suspect music choices, is not deserving of a driver's license, would certainly be liable for the harm that he caused in this accident. Wow. What a terribly reckless driver.
