Hi, this is Attorney Gabriel Levin from the Levin Firm, a personal injury law firm here in Philadelphia. The topic we're gonna discuss today is how long you get to file a lawsuit in either Pennsylvania or New Jersey. This topic in the law is covered by something called the Statute of Limitations. Statute of Limitations is a legislative act that limits the amount of time a person gets depending on the nature of the lawsuit, to file a particular lawsuit. For personal injury cases in Pennsylvania and New Jersey, the statute of limitations allows for 2 years from the date of the incident.
There are exceptions to that rule, but generally speaking, you'll have 2 years from the date of the filing. Personally, I like to file long before the statute of limitations comes up. The reason for that is that litigation can sometimes take 12 to 18 months to conclude. And if you wait too long to file the lawsuit, by the time you get around to speaking to witnesses or to filing motions, some of the evidence may have been lost or spoiled as a result of the passage of time. So by filing early in the statute, I give myself plenty of time not only to collect all of the evidence, but to prepare for trial in the most effective way possible.
A lot of people wonder if they've waited too long to file a lawsuit and whether or not that delay has affected the value of their potential claim. The answer to that is it, it shouldn't affect it at all if your lawyer presents the evidence correctly. The purpose of a lawsuit is to compensate the victim for the harm that they sustained as the result of someone else's negligence. When you suffer that loss, the lawsuit is supposed to give you back that which was taken from you. And so whether or not that was taken a year and a half ago or 2 years ago, or was taken last week, the value of that loss doesn't change.
So you shouldn't worry that you've waited too long to file your lawsuit. If you have a good attorney, a competent attorney that can collect all the evidence of your harm and make the case for the injuries you've sustained, the value should be the same.
